Terms of Service

1. What QuinielaPool is

QuinielaPool ("we," "our," "us") is a software-as-a-service platform that helps private groups of friends, families, and colleagues organize friendly sports forecasting competitions for major soccer tournaments (FIFA World Cup 2026, LIGA MX, Premier League, La Liga, UEFA Champions League).

We provide pool management, prediction tracking, and live leaderboard tools. We charge a flat $2 USD per pool created (the first pool per user is free) for access to this software.

2. We do NOT handle pool money

This is the most important point in these Terms. QuinielaPool is not a gambling operator, not a payment processor for pool funds, and not a money transmitter.

  • We do not collect entry fees from pool members. Pool money is exchanged directly between members using their own payment apps (Venmo, PayPal, Mercado Pago, Zelle, cash). The pool creator is responsible for collecting it.
  • We do not hold pool money in escrow. No member funds ever touch our bank account.
  • We do not pay prizes to winners. The pool creator is responsible for distributing prize money to the winners after each tournament.
  • We are not responsible for disputes between pool members regarding payments, prize distribution, or scoring disagreements. These must be resolved between the parties involved.

The only money that flows through QuinielaPool is the $2 platform fee paid by the pool creator to us, in exchange for using our software. That fee is processed by our payment processor (Stripe) and is non-refundable except as described in Section 5.

3. Accounts

Pool creators must sign in with a Google account. Pool members can either sign in with Google or join as a guest (name only — no account required).

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a pool. By using QuinielaPool you represent that you meet this requirement.

4. Acceptable use

You agree NOT to use QuinielaPool to:

  • Operate any form of commercial gambling, bookmaking, or paid prediction service.
  • Solicit, collect, or process member entry fees through any system that holds funds in escrow without proper licensing.
  • Defraud, deceive, or scam pool members.
  • Use the platform for any unlawful purpose.
  • Interfere with the proper functioning of the service or attempt to access systems you are not authorized to access.
  • Misrepresent your identity or impersonate another person.

Pools must be private competitions among personal acquaintances. QuinielaPool is not licensed as a gambling platform and pools must not be marketed as such. Regulatory compliance for the underlying money exchange between members (Venmo/PayPal/etc.) is the pool creator's responsibility under their local laws.

5. Platform fee and refunds

The $2 platform fee is charged when a pool is created. Refunds are available only if:

  • The service experiences a technical failure that prevents the pool from being created or used (we will issue a refund or apply a credit to a future pool).
  • The pool was created in error and no member has joined yet — contact us within 24 hours.

We do not refund the platform fee for pools where members joined, predictions were made, or matches were played. Bypass codes (issued at our discretion) waive the platform fee entirely and have no monetary value.

6. Match data accuracy

Match schedules, kickoff times, and final scores are synced from third-party sources (football-data.org, ESPN, and similar). We make best-effort attempts to keep this data accurate but make no warranty as to its correctness.

If a discrepancy affects pool scoring, the pool creator may use the admin recalculation feature to correct it. Disputes over scoring are between pool members; QuinielaPool will not arbitrate.

7. Intellectual property

QuinielaPool, the QuinielaPool name, logo, and all related software, designs, and content are our property. League names, logos, and team marks displayed on the platform are the property of their respective owners and are used for identification purposes only.

8. Service availability and changes

We provide the service "as is" and may modify, suspend, or discontinue any feature at any time. We aim for high availability but do not guarantee uninterrupted access. We may change these Terms at any time; continued use after changes constitutes acceptance.

9. Limitation of liability

To the maximum extent permitted by law, QuinielaPool and its operators are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in platform fees in the 12 months preceding the claim.

We are specifically NOT liable for:

  • Pool member non-payment, prize-distribution disputes, or fraudulent behavior between members.
  • Errors in upstream match data that affect scoring.
  • Loss of guest identity due to localStorage clearance or device changes.
  • Service interruptions or data sync delays.

10. Termination

You may stop using QuinielaPool at any time. We may suspend or terminate your access if you violate these Terms. After termination, pool data may be retained for a reasonable period for legal compliance and analytics.

11. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Washington.
